Right of Entry AGREEMENT

Permission is hereby granted to the Clear Lake Environmental Research Center (CLERC), its officers, employees, or its authorized agents, to enter upon the land described below (address or APN) for the purpose of fire fuel reduction pursuant to the requirements of the Community Wildfire Defense Grant.

This is not a request for a permanent easement and /or right-of-way, and this permission will automatically terminate upon completion of the work.


  1. CLERC will defend, indemnify and hold the Landowner, their agents, or employees harmless from all claims, demands, or liability arising out of the described work, to the extent such claims, demands, or liability arise from, or are related to, the negligent acts or omissions, or willful misconduct of CLERC or their agents, employees, or persons acting under them. Such duty of defense and indemnification shall extend to claims, demands, or liability for personal injuries or death arising out of, or alleged to arise out of, or resulting from CLERC’s agents or employees on the property.

  2. Landowner will defend, indemnify and hold CLERC, their agents, employees, contractors or subcontractors, and funding agencies harmless from any and all claims, demands, or liability arising out of the described work, to the extent such claims, demands, or liability arise from, or are related to, the negligent acts or omissions, or willful misconduct of, Landowner or Landowner’s agents, employees, invitees, contractors, or persons acting under any of them. Such duty of defense and indemnification shall extend to claims, demands, or liability for personal injuries or death arising out of, or alleged to arise out of, or resulting from Landowner’s agents or employees on the property.
